However framed to OP, the FAA rules (which apply here because DL is a US carrier) are that the passenger is not to be served if "he appears intoxicated." 14 CFR 3-3546.

The FAA rules require that the PIC and the relevant staff complete a written report, so there will already be one on file, whether OP complains or not.

More than likely, DL will commend the Captain and others involved for their actions.

For what it is worth, don't focus on the exact language used. Staff are trained not to directly confront passengers when avoidable. E.g., "I think you're drunk" becomes "you appear to be over the limit" (even though there is no established limit by number of drinks). This also has nothing to do with a "threat." If a threat, OP would have been denied boarding. This had to do with serving booze.

thanks everyone, I am a first time poster and appreciate all the feedback.

this particular response above is exactly correct, I talked to Delta yesterday and there is open case, file, noted etc.

they were very nice and said my version of what happened and their notes are nearly identical, but couldn’t tell me the actual reason or person that made the decision when how or why until after the “investigation” is closed. They even had copies of my correspondence with delta on twitter during the flight already under my name when I called yesterday.

I don’t want anyone fired or sued or anything other than a simple explanation.

they seem to be very willing to do so, on their timeline, which is fine. Thanks again

I wonder if someone didn't like OP's political views?

I had a three hour layover and I went in the smoking lounge and bar near gate E6. Made a friend, talked church politics and cars.....normal stuff. Two hours and 3 beers.

Got on the plane got my seat and waited for the plane to fill.

lady next to me turned out to be delta pilots wife (not this flight but he was on and next to her for observing the landing and takeoffs for some training apparently) and we were talking and laughiing.....

The lesson here is to stop sharing your views and/or being so gregarious. If Delta applies this “rule” to most D1 passengers, the international flights would have nobody sitting in D1. It is possible you were drunker than you thought you were. However, more likely, your conversation/views/gregariousness caused someone to complain.

Thanks for coming back and updating!

I'm still a bit curious as to the "suspicions" you mention in your first post. We've all been speculating around what we know, but you as OP are likely the only one with direct knowledge here so your speculations would be interesting to hear.

I just didn’t want to turn it into a political or religious thread...I really wanted to stick directly to delta and FAA policy.

yes I take all the blame here for talking with another person in public where other could hear. Maybe I’m just too naive. I never get mad or argue or even care what other people think or believe, we are all human and equal and nothing political or religious should cause anyone of us judge or dislike one another.

I guess I underestimated how people make negative assumptions about you based on whatever you believe.

i suspect the gate agent who said “I heard what you said in the smoking lounge” assumed because of my views incorrectly assumed I was part of a demographic that would judge or dislike his demographic, which is totally untrue.

again that’s just an assumption on my part and I didn’t want to really lay it all out, as assumptions is what lead to this in the first place, and assumptions are not a good thing, and I’m equally guilty in saying that as he might have been.

again, I take the blame, as I was talking in a public place and should have known better. I am guilty there 100% but assure you I was no where close to intoxicated or anything that would be the actual problem and I only wanted to understand and know “policy” as it was stated to me in the gallery.

i will not speak again about anything other than policy and deltas and the FAA rules in this forum. I have said enough and that’s what lead to the problem in the first place.

lesson learned, blame taken, no harm done, no ill will towards anyone or delta or policy.

i simply seek understanding of what I was told.

and the issue of why did I try and order alcohol after I was told not to, I was simply seeing if the policy was an empty threat or actually true, and it became a running joke with my FA as I just ordered virgin bloody Mary’s and we all had a laugh about that. I even tried at breakfast after sleeping to see if it was a complete flight rule, as after 7-8 hours all
alcohol would have been gone and I was initially told by my he FA his orders were to make sure I slowed down....but not stop completely. Because I was in the situation I had never been I understand I simply did all of the above to see if it was a black and white decision or if there was room to make a different call, grayer areas.

hope this clears up most questions.

lastly, I’m fully capable of determining if I should not drink or drink, and if I was even to point where I wasn’t, I believe 100% I should and would rightly lose any right to be on a plane, and I would take that blame as well.

thanks again to all the more experienced fliers for helping me undetrstand the rules and policies.

The unanswered question is how many drinks had the OP consumed that day. I suspect he had a drink or two before boarding in STL and almost certainly drank in first on the STL flight. Then 3 beers in the lounge before the ATL flight. If that is the case he was intoxicated by any legal definition and probably should have been denied boarding. It’s quite possible that the flight attendants on his STL flight called ahead knowing he had a connection that he should be evaluated. The standard the FAA holds airlines to is only that the passenger appears intoxicated.

I'd like to know how many drinks OP had all day, before presenting for boarding.

Exactly....

"Yesterday I started in St. Louis and flew to Altanta. Great flight, thanked me for being platinum all the normal stuff."

Curious as to no mention of any PDB or more on that flight.....did I miss it being mentioned?

Delta75 Dec 25, 2019 8:54 am

STL-Atl

Ok some of the abbreviations I have to guess....PDB is pre drink boarding? Not sure but as to this...I drank zero alcohol before the St. Louis flight and Bloody Mary on the fligh that I would assume had one ounce of vodka in it.
stl to atl is only about 1 hour 20 minutes total and it was too early and too short to drink more than that. Also I knew I had 24 hours of travel ahead of me and I couldn’t mess any of it up because I was flying to Brazil alone to see my wife and daughter and Brazilian family on Christmas Eve. Too much at risk to drink too much

Now it sounds as though the employee heard something and got his feelings hurt and decided to retaliate on the OP in the only realistic way he could making up some faux policy in order to justify it. No matter what the OP said (with the exception of language threatening to the flight or something of that nature), the employee acted completely unprofessionally and should be disciplined.

It also doesn’t really explain why the GA was at a bar listening to customers in the first place.
