Delta sued by Port Authority

This is ridiculous! Delta suing against New York Port Authority about what happened Delta MD88 skidded off runway at LaGuardia in 2015.

Why is this "ridiculous"? If DL was negligent, why should it not pay for a new fence? (Insert elephant joke here.)

What's ridiculous is that Delta didn't just pay for the damage they caused.

Why should taxpayers and passengers pay for Delta's error?

Yeah, this kinda stuff is fairly common. State departments of transportation, and turnpike authorities constantly bill motorists and insurance companies for damage to their infrastructure. Things like guard rails, light poles, jersey walls.

Specific to this incident, braking action was reported as good. Runway Visual Range was 6000.

I mean it's pretty clear the Port Authority has a decent case, DL should probably just settle and pay their bill, and now legal fees.

Folks should read the NTSB report: https://www.ntsb.gov/investigations/...ts/AAR1602.pdf

PANYNJ probably wants to Delta to pay for all of the damage. Delta probably says PANYNJ has some responsibility. Let the courts sort it out, fairly standard.

Correct. Each side will posture and extract whatever publicity they can get, then quietly negotiate a compromise. And in the end, their insurance carriers will probably pay it anyway.

It was pilot error. Delta needs to pay up.

Aren't you the same person who called the claim "ridiculous"?

The problem is they reported the braking action as good and The last runway condition report was two hours old. The braking action was closer to fair and the runway surface condition was Ľ inch cluttered which was not reported to the pilot. The airport was faulted for this in the accident report so I suspect Delta feels the airport has some responsibility.

NTSB says that it was medium at worst and likely good. The pilot applied too much thrust to the thrust reversers and unequal thrust led to the deviation. The pilot exceeded not only the limit for contaminated runways, but also the (higher) limit for good runways. There are some contributing factors highlighted that LGA would be responsible for, but had pilot not exceeded limits the accident would not have happened.

Airlines and airport authorities are constantly suing (or threatening to sue, or settling so they don't have to sue) each other for various things that happen on an airport. This is really just another mark in the scorecard.
