Seeking advice from the Experts on Bumping!
 
Hello, i had to unfortunately re-register due to change of emails long gone.
But a few years ago, i was a bit more active on this fantastic forum.

my question is this

my young daughter 16, was taking delta and airfrance roundtrip to GOA from indianapolis. I paid $1986 for this ticket last summer, a heavy price i feel.

nevertheless, on her return via CDG she was escorted by my sister to the gate with her printed boarding pass in hand. Within an hour they took it and re-issued another for a flight 7 hours later. They only said there was a glitch.
She sat there crying while she saw her plane being boarded.

Delta stated to me that the flight was not oversold, thus she was not bumped, therefore no compensation. Should i pursue this?
Unfortunately , they lost her luggage on both routes as well. They did compensate for that.
Lastly, she is a frequent flyer since 2 years old and a gold Delta american express card holder- in her own name.
please advise?

Let me get this straight.

How did they "take the ticket and re-issue it"? Was she at the gate and tried to board and was denied boarding? Did she get to the gate on time? Did she miss boarding?

Did she ever recover the baggage?

Look up what credit card you used and see if it has trip delay protection (doubtful it would cover her, but a worth a glance)

Also, do a search for EU 261/2004. I'm no expert, but that might be your only choice for recourse.

which airport did the bump take place at?

Who actually operated the flights?

What was the actual 'glitch'

EU261 might apply but getting DL to pay it might be a challenge - that's if they are even the airline liable.

thanks for the quick replies.
she was at the gate arriving from goa on airfrance/delta ticket.
before boarding they called her name and took her ticket and said she is not on the boarding list because of a glitch in the computer system. They then re-issued a flight from cdg to boston to indianapolis - seven hours later.


her luggage was lost arriving goa for 6 days- her luggage was also lost returning for five days.

does that help clarfiy?

No. There is no such thing as an AF/DL ticket. To make things simple, please answer the following questions:

1. Date
2. Departure airport at which your daughter was told that there had been a glitch.
3. Air carrier operating the flight on which she was ticketed from CDG. (This is either AF or DL, but cannot be both).
3. Time she was originally scheduled to arrive back at IND.
4. Time she actually arrived back at IND.
5. What exactly was she told about a "glitch?" I just don't see an agent at CDG using that term.

With that information, people here may be able to provide you useful information about compensation claims which she may be able to make.

sorry, i will clarify

july 7 delta flight 8658 from goa to cdg. arrived on time to cdg. no problems there.

arrives plenty of time at the gate with printed boarding pass.
delta 99 leaving at 10:50 am .connecting to delta 3581 .

the agent call her name before boarding takes her pass, tears it up, says"there is a glitch in the system" and her name is not there.

she then is issued another boarding pass for
delta 8604 from cdg to boston and delta 4180 boston to indianapolis.

they offer nothing for her , my sister had already left for her flight to SFO.

hope this helps. what do you think?

the air carrier was airfrance at the CDG airport.

she was supposed to have arrived at 4:43, instead she arrived after
11pm

She deserves compensation. The issue will be the he said / she said between AF and DL.

I would start with DL with a simple statement of being denied boarding on the flight. You are looking for something like $650 cash or an equivalent offer.

If that fails, you can try AF, or try again with an EU 261 threat. I would not use the EU 261 threat until after initial attempts failed.

Seams like the concept of AF thinking they can tear up DL tickets is not unusual.

i did that.
first, i called customer service , then they sent me to three other departments all of them replying how shocked that this happened.

then the last one told me to email them.
this is their reply:

Thank you for your additional comments. I appreciate the opportunity to provide you more information and to specifically address why the compensation you are referencing is not due. The EU compensation you are referring to is only due to a passenger who was involuntarily denied boarding due to an oversale of a flight. Delta Flight 99 on July 7 was not in an oversold situation. Our records show there was a technical problem with the check-in system at the gate, and the agents were unable to resolve the issue in time for Kathryn to board the flight. Again, I'm so sorry for your disappointment.

what exactly should we do now?

I'd bring it up with AF.
There is the possibility that this was caused by US security regulations. Perhaps your daughter was not checked in through and when she showed up at the gate in CDG it was too late to add her to the list of passengers that it is forwarded to DHS.
It would still be AF's fault, but maybe that is not covered under EU261, since technically it would be US authorities denying passage.

Still she is due compensation, though.

Maybe the "glitch" was a non-rev, or a VIP, wanting to get on that flight. The plane should have left full, though, and therefore oversold by definition.

IIRC there are provisions in EC261 to the effect that if you have a proper ticket and matching reservation and if you checked in on time (and reported to the gate on time if applicable), the airline cannot avoid compensation by claiming that there was a problem in the computer system, they were unable to find ticket/reservation, etc.

Me think something is missing from the story.

AF computer is not good at passing check in information to DL computer. It is likely that she didn't check in on DL flight, despite AF issued BP, and missed check in deadline.
