MBNA - 10 months late
 
Had a message from MBNA yesterday. It seems they were doing some auditing and they noticed that they didn't charge me for an airline ticket back in November of 2005. I pulled out the old statement and sure enough, it wasn't on there. The statement was sufficiently large that month so I didn't notice it at the time. They are now going to run the $575 charge through which I understand but find very annoying. Very easily could have gone the other way - any guesses as to their "audit" catching that kind of mistake? What if I caught a false charge 10 months after the fact - do you think they would be so accomodating in refunding my money? Just more reasons I guess why I should reconcile my statements when I get them.

The situation happened because one of the tickets was paid for with Worldpoints (yes, it actually worked and wasn't that bad of a deal!) and the other was to be charged to the card.

Well it might be legally "irrelevant" but its sleazy, we all know we wouldnt get the same protection.

I do not see any legal issue, only an ethical one. Recipriocity is irrelevant. Conjectures about how the other party might behave if the roles were reversed don't relieve you of your obligation to pay.

If the original poster had said that MBNA wanted to charge retroactive interest, or report the amount past due, there would be something to discuss.

I agree. The purpose of the message was to inform people (in a convoluted way) that if they use the MBNA Worldpoints system to make sure their statements accurately reflect any transaction that should be there.

The rhetorical questions were there just to express my annoyance.

I'm sorry what do you mean "they" did not charge you the $575?

Was the airline paid by the CC company.
Maybe the airline lost the charge in and an audit-by the airline-- discovered and corrected it.

You took the trip and bought the ticket.

Now if there is a problem with MBNA refusing to allow you to dispute a unvalid charge deferred for 9 months because it is more than 60 day even though the just billed you for it. You would have argument ( and be right) that the sixty day clock starts from when you are billed.

I don't see any validity to your complaint.

While it would have been nice to get a "missed" charge and a "freebie", They have not waived their right to bill you the amount.

I think at perhaps the three year mark, you could say, but still likely not prevail, that its unfair to try to collect but no way within ONE YEAR!

Agree. But I don't see either an ethical or legal issue. He owes the money.
