  • Existing NY GE members are not affected until the expiration of their current membership (renewals are blocked)
  • Rule applies to:
    • Vehicle exports
    • Applications and renewals for GE, NEXUS, SENTRI, FAST
  • Separate precheck memberships (not connected to GE, NEXUS, SENTRI or FAST) are not affected
  • Fees will be refunded, according to CFB officer.
  • Letter from DHS website
  • DHS statement Feb. 6

“NY gives driver's licenses to anyone.”? No, knownothing; as a matter of fact, NY does not. NY gives DLs to those eligible for a DL under NY law. NY won’t give me a NY DL unless I go jumping through some hoops that I don’t want to do for at least now.

DHS approves GE for lots of people even without DL data. DHS doesn’t need NY DMV data; DHS just wants to make a fuss about NY DMV data for reasons that are motivated by something other than doing background checks on GE applicants.

Guess I was wrong about the agreement.

Anybody. A friend had somebody doing yard work in another state who got stopped without a driver's license as he was an illegal immigrant. He went to NY and got a drivers license that lives in another state who went to NY and got a driver's license.

New York state residents can no longer participate in certain Trusted Traveler Programs, including Global Entry, due to provisions in the state's new "Green Light Law" supporting undocumented immigrants.Undocumented immigrants in New York will be able to apply for driver's licenses this week after the state's so-called "Green Light Law" went into effect Monday.
The law, which was signed by Gov. Andrew Cuomo in June, expands the forms of identification that can be used by applicants to obtain a driver's license in the state, including foreign passports and a foreign driver's license.
Unless required for federal ID purposes, the law also stipulates that "the commissioner, and any agent or employee of the commissioner, shall not disclose or make accessible in any manner records of information that he or she maintains, to any agency that primarily enforces immigration law or to any employee or agent of such agency, unless the commissioner is presented with a lawful court order or judicial warrant.

Presenting foreign passports and a foreign DL to get state DLs in the US is nothing new, and a state accepting such ID is not the reason for this DHS shutdown of GE (and some other TTPs) when it comes to NY applicants for such DHS programs.

States have been lawfully issuing DLs to whomever the states wanted to under state law, and they have been doing it for many, many years; and the states doing this has worked better for me than the alternative of having drivers driving around without DLs in the US or driving around while fraudulently using real DLs. And in any case, NY accepting foreign passports and foreign DLs is not why DHS shutdown NY residents’ GE applications.

GU once again YOU ARE WRONG. It is not that they are issuing DLs to anybody, but that they are now not allowing the feds to monitor their data base

Their database isn't the only source of the information DHS claims to be needing access t. They still have access to all the information they claim they need access to for GE. But they want more -- for other purposes. So they obfuscate.

Cuomo would allow access to DMV records except SS#s. This was rejected.

No doubt this is a political and not a security issue. I won't post an opinion in this thread.

Dont see how. Compromise would allow access to everything needed to review applicants. Only thing missing would be SS numbers. Including SS # would allow easier identification of immigration status. Nothing to do with Global Entry applicants whose citizenship status is verified by passport.

Whether or not NY should be assisting in locating undocumented residents holding NY DL is a political discussion.

SS#s are not allowed (or forced to be used) on any states DL per federal law that the SS is not an ID number

But since they do and don't allow Gov to their data base wheb Gov says they need to is purely a security issue

You are mistaken. NY asks for your social security number, a card if available. Alternatively an applicant can sign an affidavit stating he was never issued a SS number. Go to NY DMV site if you feel the need to verify. An original SS card is required if you're applying for a real ID DL.

Presumably people who were issued a license without a ss number have questionable status.

NY folded. Everything in the database will be made available except SS number or lack thereof.

PURE POLITCS. No other way to spin it.
