That's probably a question for another website altogether, but can a private contract state that a given behaviour constitutes fraud, and thus lead to criminal charges?

In this context fraud should be construed as a ‘wrongful’ action rather than a ‘criminal’ one. In this context it would be a civil fraud and fall under the jurisdiction of the civil courts should the victim of the fraud wish to seek damages for the wrongful act or breach of contract.
