My car was damaged while it was parked

An RV ran into my Avis rental car while it was parked, breaking a tail light and denting the bumper. Fortunately, the guy didn't bolt and reported it to the police. I declined all insurance from Avis. The car was still driveable, and I kept it for the remaining 3 days of my trip, based on advice from Avis' customer service 800-number.

Since this was obviously not my fault - we have the police report to prove it -and I got the other guy's insurance info, do I have anything to worry about? I also used a credit card that claims to cover rental car insurance.

Think you are stuck for the damage. It wasn't AVIS' fault. Hopefully, it will take the other guys insurance information and leave you out of it.

Credit cards often require immediate reporting. Be sure to let your card issuer know ASAP.

What usually happens is that they might keep your deposit till the cas is solved; Avis gotten the money from the damage casuing party. Then they will credit it back.
They even ask for a deposit when having a real full insurance with no limits, do not know why.

If the other party's insurance information is valid, avis will contact the other party's insurance through back end channels to seek payment. If those back end channels are unavailable, or the information is incomplete, avis issue a letter of demand for payment to you, the renter. You should contact your credit card company and perhaps your insurance company depending on how the laws/rules of your state/policy stipulate. In some states, credit cards are considered primary in all cases, which is good news. In other states, your personal insurance is primary, which means before your credit card company will pay up, they need a letter of settlement or denial from your personal insurance company.

In either case, your credit card insurer and your personal insurer will handle all the litigation in obtaining payment from the responsible party and Avis will wait for their money as long as it is a "reasonable timeframe" and the insurance companies are actively working on the case. if it stagnates, they will demand money from you once again.

Got an Avis rental through Priceline

I have a 3 day weekend rental prepaid via Priceline and woke up this morning to see a scratch of paint 2-3 inches long and 1/2 inch wide from the right rear side of the minivan while it was parked overnight in the hotel parking lot. The hotel has no cameras but I went though all the cars in the parking lot to see if the guilty party was still around. To no avail.

I have a hold on my AMEX card for incidentals and will be returning this car tomorrow morning; what is my best course of action? I did not call the police (since no second party) and I have not contacted AMEX nor AVIS yet. I declined LDW. Any similar experience from anyone? This happened in FLL .

Do you own your own car and have insurance on it? If so, it is possible that your insurance company will cover you for damage to the rental car, subject to whatever deductible may apply. If you do not own your own car, and put the Priceline charge on a credit card, contact the card issuer to find out whether you are covered for LDW on rental cars rented through Priceline.

depending on state, your own personal car insurance if you have it may be primary or secondary. Amex will require that you paid for the priceline purchase via amex as well, and the incidentals will be placed on the amex card. if you do this, amex will cover your car. Regardless, avis will come after you for damages. you need to give the information to amex. Amex will tell you if, by state law, you must contact your personal car insurance.
