On the Acela, is 1D always an empty seat?

I'm booking tickets into next year and have noticed that 1D is always unreservable. Is that an empty seat for the conductor? It's not marked as handicapped, either.

Thanks for the image. You were able to pick the seat? I've looked at 20 or so Acela tickets for next year. Every train and every car show 1D as already occupied.

I was preassigned to it. Not an ideal seat anyway given limited recline, lav proximity, and 50% chance of going backward. But on my trip there were very few other empty seats.
