A lot of us have spend a lot of money buying your product. We read (and made copies of) the terms and conditions carefully (the orginal ones: before you changed them) and there was no indication that your company would back out of your obligations.

Because of the large amounts of money that we have spent on this, and the refusal of your company to honor its obligations, we cannot passively accept this. We WILL contact all major (and many minor) media organizations, and we will take legal action if this matter is not satisfactorily resolved.

I appreciate your efforts to post on this site and to inform us that you will honor some of your obligations; however, the ball is rolling. Many of us are ready to start making a lot of noise about this, given how much we stand to lose. If you are sincere about your offer (and I do not doubt that you are) then please let us know, in some sort of verifiable manner, that you are who you claim to be.

Unfortunately, we cannot wait until next week before making noise about this issue. Your company specifically chose to back out of your obligations on a Friday afternoon, and I would therefore only think it prudent on your part to have someone to clean up the mess the next day.

I have posted a list of questions here (http://www.flyertalk.com/forum/showp...postcount=474), and I would appreciate some more information. I am willing to wait until the late afternoon today (Saturday) before I start contacting people about your company's actions.

Consumer Fraud

So, Mr. Schilt, if I am reading this correctly, you are telling us that you put far more products with redemption codes into circulation than you either 1) purchased miles for; or 2) plan to allow people to redeem.

Now, where I come from, people call that consumer fraud, and it gets them sued in a class action suit.

But that's just where I come from.

While Emmi have behaved badly, I disagree that it's fraud; they have the ability to buy more AA miles (which is exactly what we want to force them to do) - it's not like they were over-promising a finite commodity. It's really no different from airlines over-selling seats - they simply mis-calculated.

Hyperbole like crying "fraud" isn't going help us here; let's be calm, collected and rational while firmly pressing our case - they will take that a lot more seriously, and the more seriously they take us the better.

No I have not. I wonder if they have abided by their 2 week rule with anybody.

here is where they mentioned the 2 week rule before they changed their website:

PLEASE, let's not fight among ourselves.

That said, as a fellow attorney, I have to agree with dgwright. If a company puts out coupons WITH THE KNOWLEDGE that they do not have the resources to redeem them, that indeed is fraud.

BWDIK, I only prosecuted fraud.

hmmmm. now what?

This company hasn't exactly proven itself to be the most ethical and honest of firms; so, should we continue to contact the media or wait like they want us to?

Maybe it won't hurt to at least have the media interested in this story. That way, there are a few more checks and balances thrown into this.

I will give Swiss Bliss and the Emmi corporation the benefit of the doubt and wait to see what is posted on their website on Monday.

It looks very likely that this will be resolved satisfactorally for all. If it appears differently next week there is more than enough time to contact the press and/or take legal action.

Have a little faith.

Here in New York State, home of Emmi USA, Inc., consumer complaints are investigated by the Attorney General. You may have heard of him; his name is Elliot Spitzer.

Well, I'm not an attorney, but good to see that we have at least one posting on the thread. It would be very good to have an attorney explain some of the basic legal principles and recourses in a situation like this; I realize that you are unlikely to be willing to say anything that addresses the specifics of this case directly, but a general explanation would be very helpful.

I'm reasonably satisfied that we will get all our miles. However, I think it is deceptive, if not outright fraud, to still have product on the shelves that promises the buyer 500 AAdvantage miles when the company has no intention meeting that obligation. They should promise to honor all codes redeemed.

If they want to limit the their exposure, they need to work fast in pulling all remaining promo product from store shelves. They could also offer alternative [optional] choices that cost them less money for those not so into FF miles.
