"While Supplies Last"

Does anyone here think that "while supplies last" refers not to the supply of specially marked packages of cheese but Emmi's supply of miles?

A. That was obviously referring to supplies of the packages with the promo inside.

B. I'm sure AA miles are still available for purchase by Emmi so supplies are not exhausted.

C. The Emmi T&C page was posted within the last few days. I have a copy of the home page from Google's cache from 11/18 and the link to those T&C's is not there.

How can they claim this to mean the miles? This is classic bait and switch. False advertising. Surely there are laws against this?

I posted that before I saw your reference to post 337. Sorry.

I'm confused as to what we have. Are the terms and conditions posted earlier the true original T&Cs?

No, this is what we want it to mean. I'm not speculating it to mean otherwise, but I'm suggesting that the "supplies" that Emmi will refer to are, indeed, the miles, and not the packaging.

Is this what we (meaning some members of FT) have:

1) original T&C
2) screenshots
3) an email stating you can earn unlimited miles

Can we compile these on a blog somewhere? Anyone with an empty blog lying around?

I'm not buying that argument, but even if I did it still makes no difference since they just posted that page this week.

I'm not sure that the e-mail mentioned here is necessarily relevant to the discussion as a whole. The lack of a limit to the number of certificates that could be redeemed is still tempered by the "while supplies last" argument.

Regardless of how "while supplies last" is interpreted -- be it via certificates or miles -- the no limit provision merely means that a person could redeem as many certificates as they could, subject to the availability of certs or miles. That merely means that if there were 100,000 certificates available, there wasn't anything stopping one person from redeeming 99,999 of them (so long as Emmi had the miles to support them).

I don't disagree with this -- in fact, I don't believe there is any reason for a company to release a promotion where they cannot fulfill the terms as promised for every piece that they issue.

I'm just saying that I wouldn't be surprised if Emmi uses "while supplies last" to refer to the miles, and not the packaging, that's all.

Actually, there were no original T&Cs. They originally only had a link to the generic AA T&Cs, then posted the contents of post #337 earlier this week. Here's who has what:

- I have a screenshot from Google's cache of the home page before they posted the Emmi T&Cs.

- I think I can still get the cache version of the original form from google (and there's the one tarheel99 posted the link for).

- Landing Gear has the Emmi T&C's from before they pulled this garbage.

- rrgg has email about the offer being unlimited.

Emmi USA is based in New York. Anyone think we can get AG Elliot Spitzer on the case before he's sworn in as Governor?

This is one of the few times on FT that I truly think that a lawsuit is called for. They should not be allowed to weasel out of this the way that Travelocity and others do; because the big difference here is that people have lost a LOT of money.
