787 Grounding and EU261

Does anyone know if a cancelled 787 flight from FRA-HND on a grounded 787 would qualify for EU261 compensation or if it counts as an extraordinary circumstance.

i think ANA would argue that it's not, because it's a requirement from JAA, which is beyond its control.

They voluntarily grounded their fleet according to the ANA news conference...BIG difference from a directive from the JAA.

In any case, ANA is rescheduling aircraft to fill some of the slots, and have also stated they will not charge change fees etc. for ticket cancellation. See this post.

Other than that, it certainly sounds like an "extraordinary circumstance" issue - see here for more.

That's certainly good to hear. Now that the FAA has officially grounded the 787's maybe the JCAB and JAA will be next until these issues get worked out!!

MLIT has ordered JL and NH to ground their 787 fleets as of 11:00 JST.
