AMENDED PROVISIONS TO THE AEROPLAN TERMS AND CONDITIONS
effective December 19, 2022 (Effective Date)
6. Accumulation and Redemption of Aeroplan Points
In order to accumulate or redeem Aeroplan Points, you must be a Member in good standing, meaning you are fully in compliance with these Terms and Conditions and, where applicable, any additional terms and conditions of Aeroplan and its participating partners and suppliers (Good Standing).
Aeroplan Points are accumulated through the purchase of products and services from participating partners and suppliers and through purchase transactions using an Aeroplan credit card. Aeroplan Points may also be accumulated through time-limited promotional offers from Aeroplan or participating partners and suppliers.
Subject to the policy of any participating Aeroplan partner, Aeroplan Points may only be accumulated by the Member who transacts with an Aeroplan partner for which Aeroplan Points are earned and the Aeroplan Points associated with such transaction will only be credited to the Account of that Member. In the case of air transportation services, Aeroplan Points may only be accumulated by the Member who is the individual traveler whose name and Aeroplan Membership number appear on the ticket for air transportation services and such Aeroplan Points will only be credited to the Account of that Member.
In the case of an Aeroplan credit card, Aeroplan Points will only be credited to the Account of the Member who is the primary card holder of that Aeroplan credit card Aeroplan Points will not be credited to the membership number or Account of any other Member.
Aeroplan may, on such terms, conditions, and limitations as it may, in its sole discretion, establish from time to time, permit loyalty rewards earned under a rewards program offered by a third‑party (a Conversion Program) to be converted into Aeroplan Points. The account of the Member with such Conversion Program must be in the Members name so that the name on the Account with Aeroplan and the account under such Conversion Program are the same person. Under the Aeroplan Program, the intention of permitting conversions from a Conversion Program into Aeroplan Points is so that the resulting Aeroplan Points under any such conversion arrangement are thereafter used by the Member for redemptions within the Aeroplan Program and Aeroplan reserves the right, at any time, to impose limitations on the ability of a Member to engage in conversions from a Conversion Program into Aeroplan Points and on the use of such Aeroplan Points upon conversion.
Unless otherwise permitted by Aeroplan, purchases of products and services from participating partners and suppliers prior to a persons enrolment in the Aeroplan Program are not eligible for the accumulation of Aeroplan Points.
Aeroplan Points can be redeemed for a variety of travel, merchandise, gift card, and other rewards offered by Aeroplans participating partners and suppliers, all in accordance with these Terms and Conditions and any additional terms and conditions that may apply to a specific redemption. The number of Aeroplan Points required to redeem certain rewards such as flights (including those operated by Air Canada) and hotel reservations may be dynamic and subject to change depending on inventory availability, time of redemption and a series of other factors that are determined by Aeroplan and its participating partners and suppliers.
Participating partners and suppliers and the rewards, merchandise and gift cards made available may change at any time without notice.
10. Welcome Bonus Provisions
From time to time, Aeroplan and the financial institutions that issue Aeroplan co-brand credit cards (an Aeroplan Credit Card), together with their respective affiliates and business partners, may offer an incentive or bonus of Aeroplan Points (a Welcome Bonus) to incentivize a Member to become a holder of an Aeroplan Credit Card or acquire products or services (Products and Services) offered from time to time as part of the Aeroplan Program by such parties.
In connection with a Welcome Bonus being made available for becoming a holder of an Aeroplan Credit Card, such Welcome Bonus is intended as an incentive for a Member to become a holder of an Aeroplan Credit Card where that Member is not then a holder of the specific type of Aeroplan Credit Card for which the Welcome Bonus is being offered. Similarly, in connection with bonus or incentive Aeroplan Points being offered as an incentive related to Products and Services, such bonus Aeroplan Points incentives are intended for a Member who has not previously received bonus Aeroplan Points for the same Products or Services, to acquire such Products or Services.
Aeroplan may, in its sole discretion, choose to limit the number of Welcome Bonuses or similar bonuses or incentives a Member may receive in any period, and, in addition to the other remedies set forth in these Terms and Conditions, reserves the right to suspend, revoke or terminate the Account of any person who engages in a behaviour of excessive use of the Welcome Bonus offers. Such behaviours include but are not limited to: (i) applying for multiple Aeroplan Credit Cards across one or more product types or across one or more financial institutions that issue an Aeroplan Credit Card; (ii) a pattern of cancelling, or disengaging in, an Aeroplan Credit Card shortly after receiving a Welcome Bonus or similar bonus or incentive; and (iii) a pattern of purchasing and then cancelling or returning any product or service for which Aeroplan Points were issued.

Reasons for suspension, revocation or termination include, but are not limited to: (i) a circumstance where a Member intentionally engages in a pattern of activity or behavior that, in the reasonable opinion of Aeroplan, is intended to circumvent or work around these Terms and Conditions, or the terms and conditions of any Aeroplan partner; (ii) any abuse by a Member of any of these Terms and Conditions, any additional applicable terms and conditions or any benefit, privilege or reward associated with the Aeroplan Program; (iii) any misrepresentation by a Member to Aeroplan, its affiliates, participating partners or suppliers or to any entity associated with or participating in the Aeroplan Program; and (iv) any other actions or conduct of a Member deemed by Aeroplan, in its sole discretion, to be damaging to Aeroplan, the Aeroplan Program or the interests of Aeroplans affiliates, participating partners or suppliers, including, but not limited to: (i) applying for multiple credit cards across different product types (e.g., Entry, Core, Premium), across multiple financial institutions that issue an Aeroplan Credit Card in order to circumnavigate these Terms and Conditions or the terms and conditions of any such financial institution issuing an Aeroplan Credit Card thereby receiving multiple Welcome Bonuses; and (ii) a behaviour of cancelling, or disengaging in, an Aeroplan Credit Card shortly after receiving a Welcome Bonus.
Where, in the reasonable opinion of Aeroplan, a Member has violated these Terms and Conditions, Aeroplan may, at any time and in its sole discretion, take one or more of the following actions: (i) freeze the Account of any Member while Aeroplan investigates suspected activity on the part of that Member; and (ii) refuse to credit the Account of any Member, or debit the Account of any Member.
In the event a Members participation in the Aeroplan Program is terminated by Aeroplan in accordance with these Terms and Conditions, all accumulated Aeroplan Points will immediately be forfeited.

Aeroplan may from time to time, sponsor or provide time-limited promotions and offers relating to the Aeroplan Program. The provision of such promotions and offers do not constitute a change to these Terms and Conditions.
Notification required pursuant to these Terms and Conditions will be provided to you in accordance with applicable law and Section 4 of these Terms and Conditions. For Quebec residents, such notification will be provided between the 90th and 60th day before a change comes into effect. The notification will set out the new clause, or the amended clause and how it read formerly, and the date on which the change will come into effect.
Unless you expressly terminate your Aeroplan Membership upon a change to these terms and conditions, your continued participation in the Aeroplan Program will constitute your consent to a change to these Terms and Conditions, as amended.
20. Transitional Terms and Conditions
Certain activities and transactions, including redemptions, that were made prior to November 8, 2020, being the Effective Date of these Terms and Conditions, continue to be governed by the following terms and conditions for a limited time as specified below (collectively, the Transitional Terms and Conditions):
Flight Reward Terms and Conditions: The Terms and Conditions in effect immediately prior to the Effective Date of these Terms and Conditions will continue to govern Flight Reward tickets booked prior to November 8, 2020 for travel up to and including November 6, 2021 but will be subject to the following modifications: (i) changes or cancellations to a Flight Reward ticket will be subject to a flat change or cancellation fee of CDN $100 per Flight Reward ticket plus applicable taxes, fees and charges; (ii) where a Flight Reward ticket includes, as part of that Flight Reward ticket, an infant that is not occupying a seat, and the Flight Reward ticket relates to travel that is not entirely within Canada or between Canada and the United States, such Flight Reward ticket will be subject to a discounted fare of CDN $25 plus any applicable taxes, fees and charges for each direction of travel; and (iii) any changes to a Flight Reward ticket will be subject to the revised pricing and policies of the new Aeroplan Flight Rewards which can be viewed here.
Hotel Booking Terms and Conditions: The Terms and Conditions in effect immediately prior to the Effective Date of these Terms and Conditions will continue to govern Hotel Booking redemptions, where any such redemption has been initiated by a Member up to and including November 7, 2020 for a hotel stay after November 7, 2020.
Activities/Merchandise Terms and Conditions: The Terms and Conditions in effect immediately prior to the Effective Date of these Terms and Conditions will continue to govern Activities/Merchandise redemptions, where any such redemption has been initiated by a Member up to and including November 7, 2020 but will be subject to the following modifications: Members will only be able to verify order history, delivery tracking and shipment status by contacting the Aeroplan Contact Centre.
Aeroplan e-Store Terms and Conditions: The Terms and Conditions in effect immediately prior to the Effective Date of these Terms and Conditions will continue to govern e-Store transactions, where any such transaction has been initiated by a Member up to and including November 7, 2020.
The Aeroplan Status Terms and Conditions: The Terms and Conditions in effect immediately prior to the Effective Date of these Terms and Conditions (Previous Terms) contained provisions pursuant to which Members could earn Aeroplan status. Any Member who earned Aeroplan status in the calendar year 2019 (2019 Members) will continue to enjoy the benefits that were part of the Previous Terms related to Aeroplan status achieved by such 2019 Member but with the following modification, effective as of November 8, 2020: 1) the reduction on Aeroplan Points required to redeem for Market Fare Flight Rewards will no longer apply and will be replaced with preferred pricing for Flight Rewards until December 31, 2020; and 2) the preferential rate on Flight Reward fees will no longer apply. With the modifications described above, Aeroplan status will be valid for 2019 Members until December 31, 2020 after which all Aeroplan status will be permanently terminated. As a result of the termination of Aeroplan status as of December 31, 2020, any Member (including 2019 Members) who earned Aeroplan status in the qualification period between January 1, 2020 and February 29, 2020 (2020 Members) and would otherwise have enjoyed the benefits that were part of the Previous Terms related to Aeroplan status achieved by such 2020 Member, will no longer receive any such benefits and instead will receive Aeroplan 25K Status for 2021 and a grant of Aeroplan Points (to be deposited into the Account of such 2020 Member by January 31, 2021) as follows: (i) 5,000 Aeroplan Points for 2020 Members who earned 2021 Diamond Status; (ii) 2,500 Aeroplan Points for 2020 Members who earned 2021 Black Status; and (iii) 250 Aeroplan Points for 2020 Members who earned 2021 Silver Status.
As each Transitional Term and Condition is no longer relevant, it will no longer apply and will be considered as deleted from these Terms and Conditions and any reference to them on the website will also be removed.
22. Effective Date
These Terms and Conditions are effective November 8, 2020 (Effective Date).

Given what AC gets out of these credit cards, it would not have surprised me to learn they were funding a large portion of the welcome bonus.
I'd be even less surprised now.

I notice that the first paragraph of that seems to talk about products in the same family (personal vs. business? TD vs. CIBC? Visa vs. MasterCard? Black vs. basic?), but the 2nd paragraph implies pretty much any 2nd bonus could be stopped at their discretion. I think. Amex, at least, seems to be pretty clear that you can get it once per card type (personal Gold different from Business, Gold different from Plat, etc.).

remember to sign up for the Travel Summit Oct 29-30 in Toronto---
where one or more presenters are furiously retooling their presentations which were focused on churning
It's as if Aeroplan just looked at the topic list and said umm.. no
now they just need the attendee list of name badges to start the account reviews

One of the changes in Section 6 is to prevent having someone else give your Aeroplan number when they are buying something, which seemed to be permitted under the previous T&Cs. Perfect example is LCBO... previously my friend could give my number with me not being there, now that is not allowed.

Anyway, seems to me that as retailers start adding fees for use of a CC, there will be an incentive to use debit cards or cash. I am done with paying for an AP CC now anyway.

AC does in a manner fund these bonuses because of the massive pre-purchase of points TD, CIBC and AMEX (to a lesser extent) got for their "investment" in Aeroplan when it was re-acquired by AC. Whether there is further discounting for points acquired through welcome bonuses I don't know but AC certainly seems to imply that it isn't in their financial interests to sustain multiple CC welcome bonuses by individuals..

It's annoying that the way it's written isn't very clear whether it only applies to churning the samr card repeatedly or if they can question someone who just gets the cibc card then also gets the TD card and Amex card. There's a clause specifically about churning but the other clauses seem to apply more generally. Presuuuumably that's not what they mean but...

And AC's willingness to extend / uptick status based on CC use rather than butt-in-seat exascerbates the problem for them.
Those of us who do accumulate most of our points through butt-in-seat flying should actually welcome this nature of crackdown, since if not implemented, AC's alternative would be devaluing points overall, or putting in more obstacles to high-value redemption.

11. Prohibited Activity
Aeroplan Membership is a privilege that can be suspended, revoked, or terminated at any time, for any reason, and without compensation. Reasons for suspension, revocation or termination include, but are not limited to:
[...]
(iv) any other actions or conduct of a Member deemed by Aeroplan, in its sole discretion, to be damaging to Aeroplan, the Aeroplan Program or the interests of Aeroplan’s affiliates, participating partners or suppliers, including, but not limited to: [...]
In the event a Member’s participation in the Aeroplan Program is terminated by Aeroplan in accordance with these Terms and Conditions, all accumulated Aeroplan Points will immediately be forfeited.
Aeroplan reserves the right to restrict or refuse Aeroplan Membership in the Aeroplan Program for any reason, in its sole discretion, including, if you do not meet the requirements set forth in these Terms and Conditions, if you are suspected of fraud or illicit conduct or have had an Aeroplan Membership previously revoked or terminated by Aeroplan.

I'm not a lawyer but have had to deal with contracts with the party with more power inserting overly broad language. I wonder how long before someone's 1 million point Aeroplan account gets zapped because of a 30,000 point cc bonus deemed "illicit", and they sue Air Canada arguing about unconscionable contracts of adhesion (When is a Contract of Adhesion Unconscionable? - Slaw). And will then Air Canada attempt to grind them down via delays and legal costs, or reinstate their points in return for a non-disclosure?

I don't think they would do it over one 30k bonus. They'd do it if the entire 1M was through churning.
And they do have a specific clause for that.
You may a recall a lawsuit in the past where someone's status had been revoked with a legal justification of a similar broad clause. He got his status back after involving lawyers.
