Along the same lines, I saw this in Francine's blogm from tsa tso ny:
"'Why doesn't the TSA general counsel do something to prevent TSA employees from asking to copy down a passenger's identification when he/she requests a complaint form?'
Because we are allowed to! We have the right to ask you for your ID at any time while you are transitting through the CP.
Of course, we have yet to hear ANYTHING Francine on the viability of the Privacy Act when the TSA does this.
