All airlines are subject to EC261/2004 when operating a flight departing from an airport in a territory to which the EU treaties apply.
EU law does not apply to the Channel Islands, and therefore EC261/2004 does not apply for any flights departing from the Channel Islands operated by non-community carriers - which is what Aurigny is - even for flights to airports in the EU.
