It is completely up to the property what you get.

Whilst I understand and admire people who have special agreements with hotels to waive the fee, you are unlikely to secure this unless you are a frequent guest at the property.
Thanks for sharing this in the T&C, I usually let the front desk know if I use none of the services provided by the amenity fee.
If the services are something that provides actual tangible benefits, I actually don't mind paying them..
