9+ maybe not but while looking the virgin LAX route in autumn, availability was clearly shown as 9 for multiple days. Then, later on they disappeared but all upgrades within the original 9 always cleared (looking at J seats in EF), except now when more than 9 seats are taken and upgrade has spent a month in waitlist.
