It may be different in Canada, but in the USA this choice is typically made by the merchant's
acquirer, the company that processes their card transactions. It's likely that the merchant does not know, or care, how they are classified because they have outsourced this choice as part of transaction processing. American Express likely does not have the contractual right to change it.
