I think it is difficult to blame customers in a lot of (but not all) of these situations. As Alex71 noted, they moved the transponder to the "off" position, but it still charged them. Same with the OP in this situation. I've had coworkers with the same issue..we travel with our own transponders on the dash/held up/temp on the windshield, but the "off" transponder will still read very frequently.
