Seems to be a Spain thing, as when I checked Italy the disclaimer wasn't there.
There's a new Autograph property opening in Barcelona in September. It doesn't have that disclaimer (yet). It does mention that there's free wifi throughout, which would be of use to Silver & non-Marriott members. I'll start a new thread on that property.
