The manufacturer has far more incentives than a few personal injury claims to get the design right.
One of the things that comes out of this accident is just how fault-tolerant the Airbus design is. Despite this one specific (and highly unlikely) failure mode having been overlooked in a design alteration, the effect on the aircraft could not have been more adverse than in this accident, and there could not have been more than two pitch downs in any event (although obviously the crew on the day could not have known that).
Nevertheless, I like even more the way that the crew handled it - quite superb, really.
