Flyer Sues British Airways After Bag Falls From Overhead Compartment

BA is being sued after a flyer was bonked on the head by baggage.

An English flyer is suing British Airways (BA) after a flyer alleges a bag struck his head before takeoff on a U.S.-bound flight.

Wayne Herbert, 45, a writer from north London, told the U.K.’s Evening Standard that he felt “searing pain” and “saw stars” when a flyer’s bag hit his head as he sat waiting to take off on October 28.

“Passengers sitting in the row behind were trying to load too much luggage into the overhead and dropped a bag on my head,” Herbert told The Evening Standard. “But [British Airways] have been awful in sorting this out for me, and I’m now taking legal action. They also did little to help me get home comfortably.”

Herbert claims the injury resulted in difficulties sitting at his computer to work on his novel.

“I’m still suffering anxiety — this is an ongoing injury,” he said. “The staff certainly were not checking what people were doing and I’m suffering as a result.”

A BA spokesman told The Evening Standard: “Our cabin crew gave every possible help to our customer and we are still in contact with him to resolve this issue.”

The crew cannot be all things to all people. If some ding-dong is trying to shove too much luggage into an overhead and you don't like it you can speak to them directly, offer to help or call a crew member to assist them. That said, carry-on luggage rules are a joke to the people who ignore the limits. Not fair to those of us who do.

It was probably his bag that fell on him, so no pockets to pick there. BA has the pockets, that's where he went. If I were BA, I'd sue the owner of the bag for improperly placing it in the overhead.
