Please actually read the sentence of mine which you quoted. Race is the term used in The Act; it IS interpreted to incorporate nationality.

Nothing. The issue is whether an airline operating in the U.S.can make a decision not to carry all people who are (race/nationality/gender/sexual orientation/etc.). I don't think that an airline, for example, could get away with refusing to carry women.

Yes there is a section i.e. 49 U.S.C. § 40127 according to the pdf linked by 84fiero earlier in this thread, that prohibits carriers operating in the US from discrimination based on sex, gender, national origin, race, etc. In fact that is the exact argument used by the plaintiff Mr. Gatt against the secretary of transportation in the ongoing lawsuit.

Not to cause trouble, but I just want to know: does the U.S. allow in travellers using a Palestinian Authority passport? Also, I understand that, at least some time ago, certain American Indian tribes issued passports (which allowed travel to Cuba, for example); is this still the case?

Race and nationality are not the same thing. Is Barack Obama the same race as Hillary Clinton?

The airline didn't refuse to carry him based on any of those criteria. It refused based on him not having a valid passport (by their definition).

As a Canadian, I don't really have that problem. As for Indian tribes, there have been cases of natives who claim membership in say, the Blackfoot Nation issuing their own license plates. They also issue Treaty Cards which are similar to a passport because they claim passage as a Treaty right, not granted by the government, because the treaties were made generations ago and their right of passage was guarenteed.

A non FNMI or somebody not related by blood or marriage to the FNMI cannot get a Treaty card. They cannot use membership in an Indian band as a way to say, go to Cuba, because unless they are a member of the band, they are not an FNMI (First Nations Metis Inuit). You cannot claim membership on the grounds that you want to to Cuba.

That said, the rules are loose. There are examples of Chiefs of Indian bands being granted membership and Band leadership on the benefit of marriage. I've seen perfectly white people claim membership on the most bizarre reasons.

As for the OP, why not phone the embassy and see if they can deploy some legal muscle with Priceline and Kuwaiti airlines.

It appears the U.S. does accept PA passports for visa and entry purposes:

The U.S. Department of State has determined that the Palestinian Authority Passport/Travel Document meets the requirements of a passport as defined in Section 101(a)(30) of the Immigration and Nationality Act (INA) and therefore is acceptable for visa issuing purposes and travel to the United States.

However, according to an official at the U.S. Department of State, the United States does not recognize Palestine as a country, and therefore the Palestinian Authority Passport/Travel Document does not confer citizenship.

I'm not sure how much more clearly I can say this. I am talking specifically about the legal situation in the UK (from where OP's return flight departs). The UK Equality Act says that you cannot discriminate on the basis of race. Section 9(1) of that Act reads "race includes - (a) colour; (b) nationality; (c) ethnic or national origins".

So yes, for the purposes of determining whether the airline's actions are legal under the terms of the Equality Act 2010 in the UK, the two terms have the same practical effect.

I hope the OP returns to describe what happens at LHR. I should imagine that KU will end up in some difficulties if it won't permit the OP to board, or doesn't book him on an alternative very quickly.

I just did--I replaced it with XXXX's.
PS: Since there are lots of flights between JFK and LHR, see if you can get Priceline to switch you to say AA, and get out of the "clutches" of KU.
