Passengers could sue after BA fined record £350 million for price-fixing

British Airways has been fined a record £350 million for price fixing.

BA admitted that it agreed the level of fuel surcharges on long-haul passenger and cargo flights with rival Virgin Atlantic between 2004 and last year.

It opens the way for civil claims from passengers who believe they were ripped off.

I hope both BA & Virgin are sued by their passengers as both airlines stole from their passengers. If nothing else it would stop Branson looking so smug

Looks as if a court case would get nowhere as the authorities say the surcharges were reasonable, therefore the passengers haven't lost anything

How do you make that conclusion? Even if the surcharges were "reasonable" and barely high enough to make a route break-even, one can assume that they would be lower if it were not for the illegal price-fixing. Therefore the passengers lost the difference between what they were charged and what they would have been charged without the illegal collusion.

1) That's not what the "authorities" said
2) It will be a US jury that nails BA the worst on this, I suspect.

BA Execs To Be Named In Price Fixing Probe - Report

August 6, 2007

British Airways executives are expected to be named in a price fixing probe this month as the US Department of Justice reveals those not covered by a plea deal which it announced with the airline last week, a UK newspaper reported.
