While I am not an accountant and cannot provide tax advice, why would you give them your information now? The only thing LMT can hold against you is the threat of canceling your room, they can't do that now.

Now I got a call from LMT requesting the info. Ignored the call. I agree, I do not see any reason to give them the info but at the same time, I wanted to get other opinions from FT too... thanks ClimbGuy.

My understanding is that providing info for a 1099 is not legally required. However, doing so does not get rid of the tax consequences. Even if a 1099 is not filed, you are required to include prize winnings in your gross income (26 USC 74(a)). that includes situations in which the prize is valued under $600 (where a 1099 would typically not be issued). Whether you would be caught is a separate issue, but knowing that you won a prize (if you accept that conception of the promotion) and, in bad faith, failing to report the income, should be tax fraud under the code.

OK. Now what about all the non-US folks who won, using their non-US credit cards (or perhaps even their US credit cards? Are they legally liable even though they circumvented the system, won a room, and successfully completed a stay? Look through the postings and you will see that these were not necessarily isolated incidents.

Well, the legal liability there has nothing to do with the 1099. At that point, you've already violated the contract and all you care about is enforcement.

When our refrigerator broke and we lost some leftovers, the resort gave us two free tickets for the Sanibel Princess cruise, and a free bottle of champagne.

Got to see a Red Sox game. Walked the beach of Sanibel Island. Ate TONS of shrimp. Took a nap in a hammock. Attended many aerobics/pilates classes. Enjoyed evenings on our large waterfront balcony. Layed by the pool. Went to some local bars and restaurants. Wow. Just fabulous. I truly want to move there.

Best week of my life. Thanks Last Minute Travel! And thanks to the members of flyertalk.com for all the discussion about this promotion! Cheers to all.

this may be true, however i i were in the position of already having stayed at my hotel, i wouldn't declare the income on my tax return. If for some reason I get an audit i would present the original T&C that state the promo is not a prize or giveaway.

Yes yes, I was one of the "lucky" ones to get this $0.00 thing.. So, actually, I'm getting this free. I'm looking forward to this. I will take many pictures and post in on here and i might make a TR on this. Has anyone on here stayed there before? I'm guessing you went to their website to have a lookie? Normally the cost to stay there range from $260-400 a night ! I'm looking forward to it

just got back from my stay at the St. Regis in NYC and had no issues at all. Was even upgraded to a suite without asking or charge. all taxes and fees were included so my bill was 0.0 upon checkout.
and while they obviously knew i booked through lastminutetravel, was treated like i was an ambassador the whole time. how in the world doormen that i had never previously seen would know my name and greet me with a "welcome back mr...." is beyond me. i don't even care about the end of year taxes. how often can you stay in a $1300 per night room and not come out of pocket?

couldn't have been that b/c all i had was a carry-on bag that not tagged due to my puppy chewing it to shreds after i stupidly left it on the floor the morning i left!
probably was just the last person left to check in that day b/c i got in at 5. i don't know. great great 6 days!

though while walking through the lobby on my second night, i heard a guy at the front desk saying to the staff "well why did it get canceled and how come i didn't know?" all i could think on the ride up the elevator was that it was a LMT winner who didn't send in his tax info. should have just been nosy and hung around to hear.

Hello folks

Well im all checked into the Graves 601 Minneapolis, and i have got to say wow... amazing... I was greeted at the door by the bellhop by name, which was like wow... They didn't even know when I was arriving at exactly nor have I ever stayed here before. Check in was a breeze. At the fron the the bellhop took my luggage directly to my room. After checking in, I then to my room to set my backpack and rollerboard in the room. Shortly after, the bellhop arrived with my luggage. Dang!! Amazing.. Shortly after, I then went went to have lunch at the Cosmos Restaraunt in the Hotel. The decor is very trendy and hip. I really like it. Wow, the food was fabulous! Have their Cosmos Pad Thai! Its great!!! All i can say about this hotel is wow! Amazing... i'll keep you posted, I'm going out for dinner with some friends who attend the U of M. See ya!! !! Nor did I have to pay the taxes Wow and I got an upgrade to their next best room from standard I'm going to enjoy this $300/night room to its fullest extent
