According to WISN TV's coverage of story, a strike by Midwest employees is not out of the question, but probably not before October.

Also brought out the fact that the national union has provided the ALPA local with $2 million in support.

I read on airliners.net that the Republic pilots have a scope clause that prevents other pilots from flying the Republic ERJ-170s, even if these planes are leased out.

Midwest management has stated that if the Midwest pilots agree to concessions, then they can have the 170 flying. So what is going on, wouldn't the Republic pilots scope clause prevent a Midwest pilot from ever flying the 170s?

It is going to be interesting to say the least. Is Midwest Management blowing smoke where the sun don't shine? It wouldn't surprise me if both the pilot's union and FA's union call a strike on Midwest Airlines come October. I know ALPA has funded a 2 Million Dollar strike fund just in case.

By the pictures in WISN's 5pm story the old Republic that was bought by NW will be flying MD-80's for Midwest. Apparently they don't know the difference. Weird, old file tape. Funny.

The unions better hurry up. By October there won't be many flights left to strike.

The pilots are backed into a corner. If they strike, a Chapter 11 filing would void the union contract and the court order a return to work.

How are they better off? How long will two million last?

no airline contract has ever been voided in bankruptcy. No judge is ever voided a union contract under the railway labor act EXCEPT CAL when Lorenzo was running the airline. Which then the law was changed. Unions have agreed to concessions during bankruptcy(DAL,NWA,UAL,US) but to void it. Judge would not touch that with a thousand foot pole.

As far as forcing them to work, what happens none decide to go back and just quit? Management has to be very careful how they do this. If they try to bust the union the PR alone would kill the airline.

Read between the lines, the remaining 717s will be history. Perhaps not this year, but eventually.

But to keep their 121 certificate I believe they have to continue to fly one or two instances of one type. They're already down to very few instances of one type. I suspect the pilots actually have some leverage here at this very low end of the game.

Here is the bottom line. Unfortunately, I do not believe there is much the pilot's can do about the outsourcing of the flying to Republic, as they do not have a scope clause in the current contract.
