Can I check out early for a stay (points or paid) without any penalty ?
For example can I check out the same day as arrival and not spend a night for a one night stay ?

If you are asking if you can get stay credit toward elite status without physically staying overnight, there is some info here http://www.flyertalk.com/forum/showthread.php?t=388165
If the hotel has express checkout you could also drop it in the box before leaving, presumably your checkout would then be processed as the next morning.
Award stays (points or cash + points) don't earn stay/night credit.

Some properties may charge an early departure fee, depending on your rate plan. I don't know whether that addresses the OP's concern.
I started a thread last year inquiring about checking-out of a property without being present, and the consensus was that one need not check-out at all. I suppose you can just leave early if you'd like without informing the hotel if they would levy a penalty.

For what it's worth, if you wish to depart early due to some problem with the hotel (which has happened to me more than once), they never seem to charge you for the unused portion of your stay. If you wish to leave for any other reason, I believe you are cancelling the reservation after the check in cut off time, therefore the hotel can charge you a one night penalty if they wish, which is fair if you think about it since they could have turned away other guests because you had booked the room.

In this case, let me add the following:
"When you check-in, you will be asked to confirm your departure date. You may be able to change your departure date without a penalty if your rate plan permits and if you do so before the end of your arrival day. After reconfirming your departure date, if you decide to leave earlier, you may be charged the early departure fee. Please contact the hotel if you have any questions."
This can be found in your confirmation email as well.

I'm just wanted to know how it worked if I only needed the room for a few hours. For instance if I had a 6 hour layover during the day could I check in and out on the same day and only pay my required number of points ?
I don't have to actually stay over night do I ?

If you pay for the night, you can leave whenever you want.
You might also want to call the individual property. Some airport properties have day rates so you can shower and take a nap for a few hours between flights.

That's a great idea. I've also on occasion called the property from the airport to check me out if there is no express check out, the TV cant do it for me and the front desk is jam packed. They usually email me my bill.

I know this might be a little late answering your question. Some properties can offer you to pay a day rate if you're not staying a full night. This price is usually half the rack rate. This depends on the property if they do offer it or what their policies are on what time you can check out till before they charge you a full night.
