This is a technical question so I do not know if there will be answers.

My USA children are in NZ in with a student visa obtained after arrival in NZ. We we re-enter NZ next year and we wish to enter as visitors [even though the student visa will technically still be active].

Can the immigration official ignore the student visa and apply a visitor visa [which is automatic for USA citizens] when entering the country?

Alternatively, we will have to apply for visitor visas when we are in the USA to cancel out the student visas.

Other suggestions?

I'm no real expert on NZ immigration laws - but my first thought is what does it matter given that in terms of restrictions on what you can do, a student visa is more liberal than a visitors visa? Or is it the case the the student visas only allow a limited number of entries which you wish to save.

Actually it does not matter as far as entries, etc. other than:

1) the current student visa expires just a few days after we return causing a technical hassle to get under another visa / permit (regular visitor) and

2) we have not decided if we want to be students or not for next year (a student should be going to school; a visitor can just be visiting)

I am not too sure whether you are the students or your children.

Certainly if you have a students visa you have to study and have a record of attendence at an accredited institution.

I was hoping that someone that qualifies for multiple visas (i.e. work visa) could give me feedback on attempting to come into NZ as a visitor rather than a worker.

As of now I think I will need to re-apply to be visitors even though under normal circumstances USA citizens don't have to do that.

I don't know about the USA, but I have had a lot to do with student visas/working permits etc for an Asian student, and it can be very difficult to get work permits.

I suggest you look at the NZIS site as it has a very dood outline of what can and can't be done. I would have thought it would be lot easier for someone from the States

Feedback:

I ended up sending the passports to the Embassy in DC.

Originally I thought we would need to apply as 'regular visitors,' at the end however, they were able to cancel the student visa 'without prejudice.'

Now we have re-entered NZ as regular visitors with Visa/permit issued upon entry since we are USA citizens.
