I refer you to my post
http://www.flyertalk.com/forum/showthread.php?t=467502
I recently rented a car for a few hours and drove it from LGW to LHR and as you may guess I did not inspect the car when I picked it up.

Upon returning it I was informed that there was some minor scratches to the bumper.

I did not do this damage. Yet I had to pay 150 pounds.

I think this is a scheme that they do over and over. Any experiences?

Now their THIRD PARTY insurance company is saying that was not enough and they have charged me an extra 100 pounds.

It is bad enough that I did not do the damage, but when I returned the car they proposed the original 150 pounds, and I agreed [reluctantly] to pay for it. It appeared as an 'other' on the charge. The 150 pounds is reflected on the letter to me from the Third Party.

Is this legal? My agreement was with Hertz and as I said above we verbally agreed and paid 150 pounds. I am member of #1 gold. So I don't know the fine print.

I will dispute the AMEX charge. Will I be successful?

Any suggestions other than not renting from Hertz [which I have not done since]?

When you agreed to the original charge, you probably admitted to and agreed to pay any excess for the damage. Just a guess...

i would not take it. my suggestion would be to flat out refuse to pay it. Then dispute that charge and the original charge with the credit card. then begin proceedings for legal suit against hertz.

After that, my next move would be to call hertz and hertz corporate headquarters and inform them that they will be part of a suit unless your questions on the legality and legitimacy of the claim is answered.

whatever you do, do not agree to pay anything, do not admit to agreeing to pay anything, and fight it. no matter which country you are from, you have the right to dispute any charges to your credit card and they cannot force you to pay until the dispute has run its course.

Actually, I made sure to state that I did not beleive I caused the damage on the report.

The other item that bothers me is that Hertz gave my credit card information to a third party.

Is this allowed?

Could always be one of those "or authorized agents" clauses....
