With the increasing complexity of cross-border deals and new laws in developing economies, the aircraft recovery business remains a legal and logistical minefield. The main aim of any financier must be to recover its aircraft on a voluntary basis, but a good knowledge of its enforcement rights is fundamental: first, to judge how strong a hand the financier holds for the purposes of negotiation; and second, to be in a position to move quickly and effectively if and when its borrower/lessee proves recalcitrant.
