My luggage has been missing for 8 weeks now, and I would like input as to what I am entitled to as far as compensation and reimbursement go, also the possibility of taking legal action. I flew from Newark to Dubrovnik, making a stop-over in Stockholm. The first flight was United and the second was SAS. I filed a report at Dubrovnik Airport upon arrival, and my file is on WorldTracer, which states that even the whereabouts of my luggage are unknown.

30 days after I boarded the flight, SAS sent me a Passenger Property Claim Form to submit an itemized list and receipts of the items I purchased to make up for the lost clothes, shoes, and other belongings. However, no one has given me a concrete amount as to how much they will compensate and reimburse for the purchases.

I would greatly appreciate any input you could provide me. Thank you.

Around 1131 SDR local currency equivalent is the airline's max baggage liability for your journey. Should be around $1700 (US) max.

SAS will handle/settle the claim, UA pays the bill. I'm sure SAS is pretty certain the bag never made it to ARN, hence the offer to settle within 30 days.

Article 15.2.2 in the conditions of carriage limits the liability to 1131 SDR. These are the SAS conditions, but I am sure that number is fairly uniform accros most airlines.

The number is legally uniform for essentially all trips covered by the relevant Montreal Convention, save those who declare a higher value at check-in and get additional insurance cover one way or another.

They scan all tags of luggage loaded onto flights. If they don't have a record of scanning that bag, it never made it to ARN.

That's what travel insurance is for. And if you were to have a medical emergency, you could easily incur expenses way in excess of the monetary value of your baggage contents.

does class of service figure into the amount ie eco extra or business class? or all luggage value the same? what if one has 3 bags in business and all three disappear is it 1700$ total or 3x1700?

It is defined as being the limit pr passenger, so it does not mater what class you are travelling in or how many bags you have.

I just wanted to follow up on my missing luggage saga.

After waiting hopelessly for over 2 months, my lost luggage was found and delivered to my doorsteps out of the blue. Needless to say, I was ecstatic to reunite with it. My initial travel was from EWR to DBV via ARN. To my surprise, the luggage made it back to EWR from ARN via Sulaimaniyah Int'l Airport in Iraq. Everything in the bag was there (clothes, shoes, toiletry kit, snack food, etc.) except for a mineral powder foundation. I wonder if the airport security people thought the powder was something other than make-up. I will submit the receipts and an itemized list of purchases I've made to SAS in the next few days. I hope that process goes smoothly.

Have you checked that your luggage is not damaged? If it is then you need to file a damage report with SAS.

Good point. In fact, the luggage was damaged; a strap was broken. I will file a damage report also.

I was pleasantly surprised at the turnaround time. I scanned the receipts and attached them to the on-line form on 7/27 (late afternoon, so it probably wasn't read until 7/30). On 8/2, I got an e-mail reply asking for bank account details so they could wire money directly to my account.

A follow-up question: Does anyone know where I should send (by email or postal mail) the Passenger Property Claim Form and receipts of all the purchases I made while my luggage was missing? Thanks in advance for the input.

My luggage was only missing for 50 hours, and it was delivered intact. I just did the online form.


Also, did you give them a separate itemized list of the purchases you've made? I actually have a lot of receipts to submit, and I feel the need to give them a detailed list with the total amount that I need to be reimbursed.

I did not itemize anything. The receipts we submitted contained everything we wanted to be reimbursed. If there are items on your receipts that you are not seeking to get reimbursed for, then I would probably itemize.
