I know teenagers cannot rent, but if the parent is renting and declining the rental car insurance and my personal insurance covers my teenager, is there a problem letting them drive the rental car?

Is it 'illegal' or the rental agencies just dont like?

i would run it by your insurance agent....see what the car rental says about unauthorized drivers....you should be able to get a look at the contract in advance....it probably isn't a good idea....

My agent says our insurance covers them. The rental agency says no one not listed on the contract is allowed to drive the car...but again, what is the consequence if you are covered by personal insurance anyhow? They dont rent to you again?

I'm more interested if its legal or not.

to expand a bit....the ? for the insurance agent is "what happens if he is driving in violation of a car rental contract and an accident occurs"....if the answer is no prob, then go for it...

While you may be covered for the cost of the car, what your insurance probably won't pay is loss of use fees / other misc charges that the car rental company might ask for to be reimbursed. Since you willfully violated the terms of the contract by allowing an unauthorized driver to take the vehicle, you're kind of at the mercy of the car company on those charges...

I know in MO, the breach of contract language that the courts enforce is pretty strict and sides with the party whose contract was broken (the car company in this case).

As with all legal/ ethical queries, it really comes down to how risk adverse you are...

I run a rental car office here in North Carolina and I want to strongly caution you not to do this. If we found out someone was letting an unauthorized driver (especially one we could not rent to) use their vehicle we would repossess the vehicle, not refund them their deposit and not rent to them again. As others have said, you'd have violated the terms of our contract and we would not have much sympathy for you in the event of any damage to our vehicle/tolls or tickets incurred during the rental process etc.

I discussed this issue with a college student last week. Car rental companies have special (higher) rates for anyone under 25. I asked her about corporate/government rates. It turns out these are not applicable if the driver is under 25. It seems the car rental companies have themselves covered........
