Well, we dined at the Michael Mina restaurant American Fish the week before that time frame. Thought the place was mediocre and over-priced, but fortunately we did not contract Legionnaires Disease.

Not really sure what the proper remedy would be for a meal that simply wasn't worth the money at a restaurant that we wouldn't return to. We didn't have time to wait around for something like a comp dessert or drink, as we had a show to catch.

This smacks of a frivolous lawsuit. Correct me if I'm wrong, but part of the lawsuit seems to be accusing the Aria of providing heated water in the form of a shower.

Frivolous? not hardly. I would agree with you if this was some suit covering all people who MIGHT have been exposed but did not contract the disease. This suit is by people who got sick and while they may not be able to demonstrate the merits of their claims and win the suit, it is hardly frivolous.

Bad things happen to people. The first response shouldn't be to sue. Lawsuits should be reserved for things where there's some idea that someone has done something wrong.

The list of sins the Aria is supposed to have committed, according to the article, mostly boil down to "running a hotel."

I don't think you read the article carefully. The things in the article about "running a hotel" (such as "The water was, at the time, heated, causing the water to steam, vaporize and otherwise become aerosolized, allowing it to be inhaled and ingested by" the plaintiffs...") was explaining the background and how the guests contracted the bacteria. NOT that heating the water is the "sin".

The lawsuit is for "negligent design and installation of water systems and failures on the part of Aria to inspect, repair and maintain its heating, hot water, ventilation, hot tub and air conditioning systems." [emphasis added.] Whether the judge or jury decides it is negligent is to be seen, but I wouldn't say it's frivolous to bring the case.
