I Hired a car today, and I got an upgrade, checking online I see that for the veichle I was upgraded to, I'm under age to drive it.

I was once told by somebody working at Europcar, that it's the car rental company's obligation to check these things, if you provided passport Etc. and they didn't check it, then you are insured.

Is this true?
If yes does the same apply for Avis?
(I hope so very much, as I don't want to find myself involved in something and be un-insured)

Presumably because, if he tried to rent that specific car, it falls under a category where the minimum age for rental is set at 25, 30, etc. This is very common in Europe, not in the US.

In the OPs case the reservation was made for a different type of car that presumably didn't have this restriction, but now they have been upgraded to one of these cars, hence the confusion.

I don't know the answer though unfortunately - although I would be almost certain that you are insured, and it would be the rental car company's responsibility to ensure you were not given this car if there were any issues.

I'm not sure if you are aware that every country has a different sets of rules. There are no world-wide rules and/or laws.

In US a typical rental would come with no insurance. Many countries in Europe includes insurance in basic rate, but you need to check the rental terms if this is included or not in your rental.

If in your case you're not sure, please call AVIS and ask. They should be able to give you an answer.

That was my line of thinking. If the OP reserved an eligible car class and the location gave him something different, it shouldn't be his problem.
