Put the cork back in the champagne bottle.

From a US Airways' Press Release (http://www.usairways.com/corporate/press/nw_01_0712b.htm):

"US Airways announced today that US Airways and UAL Corporation have provided the Department of Justice with the 21 days advance notice required to obtain a determination of its position on the pending merger. The parties continue to stand ready to address any questions that the Department of Justice and the state attorneys general may have in connection with the merger. There is no assurance, however, that the transaction can be consummated."

So; what do you think this means?
A. As predicted by some, recent news was a cover for a means to rework the deal (G & W get to cash in after all)
B. UAL is trying to protect itself from a potential suit from US for not actively pursuing the merger by forcing the DOJ to reject the deal as proposed (other recent press reports make it seem like UAL was not really interested in consumating the deal)
C. With all the recent noise, UAL's political allies have stepped up and they suddenly think that they can now push this past the DOJ (There has been lots of political changes in Congress in the last month).
D. An attempt by G & W to show the US BOD that they are not giving up on the merger. The US BOD meets on next week and significant decisions will need to be made. Are G and W trying to keep their jobs by putting on a good show?
E. None of above

Speculation?

Did anyone bring the silver bullets?

F. US is setting up a lawsuit against UAL because other bbs have reported that DOJ would approve the merger and this forces DOJ to make a decision, and if approved UAL to buy US. If they back out now, and everyone agrees that they are paying too much for US, then US will sue and get more than the $50M breakup fee. W&G still get $$$. US gets $$$. Or a new deal is renegotiated and W&G get $$$. Big US shareholders get cashed out at a profit and we pax get the you know what.
