US Airways, American Airlines and the U.S. Department of Justice disclosed Monday that they’ve picked a mediator to see if they can resolve any or all issues in the DOJ lawsuit seeking to block the air carriers’ merger.

·Following a hearing on Monday, today the Bankruptcy Court approved two motions that allow American to take the final steps to emerge from restructuring and for us to close our merger.
·First, Judge Sean Lane approved American’s settlement with the DOJ and the states attorneys general that were parties to the lawsuit, finding that even with the divestitures, American can go ahead with its Plan of Reorganization (POR) and merger with US Airways. Second, Judge Lane issued a ruling that allows us to close our merger prior to the resolution of a private antitrust lawsuit that is before the Court.
·As a result of these rulings, AMR filed a notice with the Court, stating that the proposed effective date of the POR will be Monday, December 9.
·That will be an important date of celebration for our people – on that day, American will emerge from restructuring and we will legally close our merger.
·While we will come together as a company to mark the day, we will not be making any changes from a customer perspective until after the busy holiday season.

NEW YORK (AP) - A New York judge has refused to block a merger between American Airlines and US Airways, saying a bankruptcy judge was right to reject the arguments made by a lawyer for some consumers.
U.S. District Judge Loretta Preska ruled Friday that U.S. Bankruptcy Judge Sean Lane was "correct in all respects" in deciding last week to let the merger proceed. She rejected arguments of imminent harm to consumers put forth by San Francisco attorney Joseph Alioto. She also refused to stay the effect of her ruling while Alioto appeals.
