Delta's data comes from Travelport (includes Apollo, Galileo, and Worldspan) and there was some news recently about new agreements between Delta and Travelport (search: delta travelport).

I'm assuming that ExpertFlyer has a service agreement with Travelport, and other providers, for API access, which is how ExpertFlyer is able to provide the information on its site. Part of this agreement would include a standard Non-Disclosure Agreement, which would help to explain why ExpertFlyer cannot comment.
