Sounds like another case of a TSO that needs to be fired.
Interesting question for an LEO, when a person gets about 6 inches from your face, that is close enough to easily transmit their germs directly into your nose and mouth, would that be considered an assault charge.

Don't know about germs, but it's certainly close enough to consider yourself physically threatened by the aggressor and thus deserves an assault charge.
